Acceptance And Eligibility

By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website. You must be at least 18 years old and legally able to enter into a contract to submit a rental inquiry or use another transaction-related feature. A parent or legal guardian is responsible for a minor's permitted use of the website.

Website eligibility is not rental eligibility. Minimum age, valid-license, payment, insurance, deposit, and additional-driver requirements are determined during booking and stated in the applicable reservation confirmation or rental agreement.

Website Information Is Not A Reservation

The website lets you view general information and contact us about vehicles, dates, pickup or delivery, and rental services. Submitting a contact form, selecting dates, calling, emailing, or receiving an automated acknowledgment does not create or guarantee a reservation.

A reservation is confirmed only when Five Guy Car Rentals expressly accepts it and provides a confirmation identifying the rental details. We may accept or decline a request based on vehicle availability, eligibility verification, payment or deposit requirements, suspected fraud, safety considerations, or other legitimate business reasons, subject to applicable law.

The signed rental agreement, together with a confirmed reservation where applicable, controls the rental. It may contain terms concerning authorized drivers, prohibited uses, mileage, fuel or charging, extensions, late returns, tolls, tickets, cleaning or smoking, deposits, damage or loss, optional products, insurance, cancellation, refunds, and other charges. If these Terms conflict with a signed rental agreement regarding a rental, the rental agreement controls.

Vehicles, Availability, Prices, And Promotions

Vehicle images, makes, models, features, condition descriptions, rates, and availability shown on the website are informational. Unless we expressly confirm a specific vehicle, a displayed vehicle represents the type of vehicle that may be available and is not a guarantee of a particular make, model, color, feature, or condition.

Displayed rates may vary by location, dates, rental duration, driver eligibility, vehicle, availability, taxes, government charges, optional products, deposits, delivery or pickup, and other disclosed items. The final price and payment schedule will be provided during booking or in the rental agreement. We will not add a charge that you did not authorize or that applicable law does not permit.

Promotions are subject to their stated eligibility, timing, location, availability, and other conditions. Promotions have no cash value, cannot be combined unless stated otherwise, and may be changed or withdrawn prospectively, subject to applicable law. Permitted Use

We grant you a limited, revocable, non-exclusive, non-transferable right to use the website for lawful personal or internal business purposes related to evaluating or obtaining our services. You agree not to:

Claims arising from a reservation, vehicle, payment, or rental are governed by the applicable reservation confirmation, signed rental agreement, and law—not this website-only limitation.

Indemnification For Misuse

To the extent permitted by law, you agree to reimburse Five Guy Car Rentals for third-party claims, losses, and reasonable costs caused by your unlawful use of the website, your material violation of these Terms, or content you submit that infringes another person's rights. This obligation does not apply to the extent a claim was caused by Five Guy Car Rentals or where applicable law does not permit it.

Governing Law And Disputes

These Terms and disputes concerning only the website are governed by applicable federal law and the laws of the state in which the relevant Five Guy Car Rentals location is located, without regard to conflict-of-law rules. Disputes concerning a reservation or rental are governed by the applicable rental agreement and mandatory law.

Before filing a lawsuit about the website, you and Five Guy Car Rentals agree to make a good-faith effort to resolve the issue by written notice and reasonable discussion. This does not prevent either party from seeking urgent injunctive relief, using an available small-claims procedure, or exercising a right that cannot be waived. Any court proceeding must be brought in a court with lawful jurisdiction and venue.

General Terms

These Terms and the Privacy Policy are the entire agreement regarding use of the website. They do not replace a reservation confirmation or rental agreement. If a provision is found unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization, or sale of the business, subject to applicable law.
