Scope And Who Is Responsible

Five Guy Car Rentals is responsible for the personal information covered by this policy. This policy applies to our website, customer-service interactions, and rental operations. It does not apply to a third party's website, service, or privacy practices, even if we link to or embed that service.

Information We Collect

The information we collect depends on how you interact with us and may include:

• Contact information: name, email address, telephone number, mailing or billing address, and the contents of messages you send us.
• Rental and identity information:reservation and rental details, date of birth, driver's-license or other government-issued identification information, additional-driver details, insurance information, delivery or pickup location, and records relating to the vehicle or rental.
• Transaction information: charges, deposits, refunds, payment method, billing details, and related transaction records. A payment processor or financial institution may collect payment-card details directly under its own privacy terms.
• Communications and preferences: newsletter subscriptions, email and SMS preferences, records of consent, opt-out requests, and customer-service communications.
• Device and website activity: IP address, browser and device type, operating system, referring pages, pages viewed, dates and times of visits, interactions with the website or our ads, approximate location inferred from an IP address, and cookie or similar identifiers.

We collect this information from you, from people who make a reservation or inquiry for you, from service providers involved in your transaction, and automatically from your browser or device.

Cookies, Analytics, Advertising, And Maps

When you submit a contact, newsletter, or text-agreement form, we set an fgcr_visitor_idcookie. It contains a randomly generated identifier, helps us distinguish new and returning form users, and is configured to expire after one year. Browser settings can block or delete it, but deleting it may cause us to treat you as a new visitor.

We use Google Analytics and Google Ads to measure website use, understand advertising performance, and improve our services. Google may receive device and activity information and use cookies or similar technologies. Because Google Ads is active on this site, Google may combine activity from this site with information from other sites or services as described in the Google Privacy Policy. We also embed Google Maps on our contact page; loading a map sends information such as your IP address and device information to Google.

You can limit cookies through your browser, adjust advertising choices in Google's My Ad Center, or use the Google Analytics opt-out browser add-on. Our website does not currently respond to the browser's legacy "Do Not Track" setting or other browser-based privacy preference signals. You may still submit an applicable opt-out request using the contact methods below.

How We Disclose Information

We may disclose personal information to vendors that help us operate, including Google/Firebase for website hosting, database, analytics, advertising, and map services; payment processors and financial institutions; communications providers; insurers, claims administrators, roadside-assistance providers, and other rental service providers; professional advisers; and fraud-prevention or security providers. These parties may act on our behalf or, for some services, under their own privacy terms.

We may also disclose information when reasonably necessary to comply with law or legal process, protect people or property, investigate fraud or security issues, or enforce our agreements. If our business or assets are involved in a merger, financing, reorganization, sale, or similar transaction, information may be disclosed to the parties and advisers involved, subject to appropriate protections.

We do not knowingly sell personal information for money. Our use of Google advertising technology may, however, be considered "sharing," "sale," or targeted advertising under certain state privacy laws, even when no money is exchanged.

Your Choices And Privacy Rights

Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, or deletion of personal information; obtain a portable copy; opt out of covered sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; withdraw consent; or appeal our response to a request. You also may have the right not to receive discriminatory treatment for exercising an applicable privacy right.

An authorized agent may submit a request where permitted by law, but we may require proof of authorization and identity verification. We will respond within the period required by applicable law.

These rights are not absolute. We may retain or decline to act on information when permitted by law, such as when it is needed to complete a transaction, meet a legal obligation, prevent fraud, or establish or defend legal claims. If we deny an appealable request, our response will explain how to appeal.

Email And Text Messages

You may unsubscribe from marketing email by using the unsubscribe method in the email or by contacting us. We may still send non-promotional messages about an inquiry, reservation, rental, safety issue, or other transaction.

If you enroll in SMS messages, message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent to marketing texts is not a condition of purchasing or renting. Opting out of marketing texts does not prevent us from contacting you by other permitted means or from sending legally permitted non-marketing messages.

Retention

We retain personal information for as long as reasonably necessary for the purposes described in this policy, including providing services, maintaining rental and transaction records, honoring communication choices, complying with tax, accounting, insurance, and other legal requirements, resolving disputes, and enforcing agreements. Retention periods vary based on the type and sensitivity of the information, the nature of our relationship, legal requirements, and operational need. The visitor-identification cookie is configured to expire after one year; third-party services apply their own retention settings and policies.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please do not send a Social Security number, driver's-license image, full payment-card number, or other highly sensitive information through an ordinary email or the website's general contact form. Contact us to arrange an appropriate way to provide required rental documents.

Children's Privacy

Our website and rental services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information to us, contact us so we can review and delete it as appropriate.

Changes To This Policy

We may update this policy as our practices or legal obligations change. We will post the revised policy on this page and change the "Last updated" date. If a change materially affects how we use information already collected, we will provide any additional notice or request any consent required by law.
